Privacy policy

This Privacy Policy and the Terms (together, the "Terms") (and the documents referred to in it), tell you the terms on which you may make use of our website www.dinermojo.com, its mobile version and the mobile App “DinerMojo” (the “App”, and together the “Sites”). Use of the Sites includes accessing, browsing, or registering to use the Sites.

Please read this document carefully before you start to use the Sites, as these will apply to your use of the Sites. By using the Sites, you confirm that you accept these Terms and that you agree to comply with them. If you do not agree to these Terms, you must not use the Sites. The Sites are owned and operated by DinerMojo Limited, a company registered in England and Wales under number 9037722 with its registered office at 22 The Quadrant, Richmond, Surrey, TW9 1BP (“DinerMojo”, “we”, “our”, and “us”). For the purposes of the Data Protection Act 1998, we are the data controller. We are committed to protecting your privacy online. We appreciate that you do not want the personal information you provide to us distributed indiscriminately and here we explain how we collect information, what we do with it and what controls you have. By using the Sites, you consent to the collection and use of information in accordance with this privacy policy. We reserve the right to change this privacy policy from time to time by changing it on the Sites.

1. Information we may collect from you

We may collect and process the following information about you:

  • information (such as your name, email address, postal code, birthday and telephone number) that you provide by completing forms on the Sites, including if you register as a user of the Sites, subscribe to any service, upload or submit any material via the Sites, request any information or enter into any competition or promotion we may sponsor;
  • in connection with an account sign-in facility, your password and log-in details;
  • your preferences, which helps us provide you with more tailored offers;
  • communications you send to us, for example to report a problem or to submit queries, concerns or comments regarding the Sites or its content;
  • details of your visits to the Sites, the resources you access and any data you download;
  • non-personal data. For purposes of this privacy policy, “non-personal data” means information that does not directly identify you. Additionally, non-personal data means “aggregate” and “de-personalized” information, which is data we collect about the use of DinerMojo's services, from which any personally identifiable data has been removed. We may use tools or third party analytical software to automatically collect and use certain non-personal data that does not directly enable us to identify you. The types of non-personal data we may collect and use include, but are not limited to: (i) device properties, including, but not limited to IP address, Media Access Control (“MAC”) address and unique device identifier or other device identifier ("UDID"); (ii) device software platform and firmware; (iii) mobile phone carrier; (iv) geographical data such as post code and coarse location; (v) other non-personal data as reasonably required by DinerMojo to enhance our products and services.
  • Information obtained from your social networking profile, if you log-in via a social networking site. You are under no obligation to provide any such information. However, if you should choose to withhold requested information, we may not be able to provide you with certain services.

2. Uses made of your information

We will use the information you provide to:

  • help us to build a profile of your preferences so we and our participating venues can offer you , venues, news, offers and services you may be interested in;
  • enable us to process your points transactions and to provide you with the services and information offered through the Sites and which you allow;
  • administer your account with us;
  • improve the layout and/or content of the pages of the Sites and customise them for users;
  • identify visitors to the Sites;
  • carry out research on our users' demographics and tracking of usage data;
  • share with social networking sites at your request; and
  • disclose to lawful authorities when required to do so by law.

We and our participating venues may also use information you provide to us for the purposes of contacting you with information regarding upcoming events, offers, services or surveys. This shall only be done with your consent and our direct marketing policy which is explained in full below.

3. How long we keep information

We will retain the information we obtain from you as long as you are a registered member and continue to use the Sites. If you choose to delete your account, we will remove any references to your personal information. Derived and non-personal information, such as average savings or numbers of Rewards selected, may be retained as part of our performance management information.

4. Additional information

When you visit the Sites, we may automatically collect additional information about you, such as the type of phone or operating system you use and, if you came to the website, the type of internet browser you use and the website from which you have come to the site. You cannot be identified solely from this information and it is only used to assist us in providing an effective service on the Sites and to collect broad demographic information for aggregate use.

5. Information sharing

We may disclose aggregate statistics about visitors to the Sites to describe our services to prospective partners, advertisers, potential merchants and other reputable third parties and for other lawful purposes, but these statistics will include no personally identifiable information. In the event that we undergo re-organisation or are sold to a third party, you agree that any personal information we hold about you may be transferred to that re-organised entity or third party. We may disclose your personal information if required to do so by law or if we believe that such action is necessary to prevent fraud or cyber crime or to protect the Sites or enforce the terms under which you transact with us or enforce the rights, property or personal safety of any person.

6. Public forums

The Sites may, from time to time, make public forums available to its users. Any information that is disclosed in these areas becomes public information and you should exercise caution when using these and never disclose your personal information.

7. External links

The App may, from time to time, contain links to external sites. We are not responsible for the privacy policies or the content of such sites.

8. Marketing to you

We may send you information we think you may find useful or which you have requested from us by push notification and/or (if you provide us with your e-mail address) by e-mail, including information about the latest venues, rewards, offers and events featured on the Sites, provided you have indicated that you do not object to being contacted for these purposes and we will always give you the option to opt-out of receiving further e-mails or push notifications by following the unsubscribe instructions on any communications sent to you, or by changing your notification settings in the DinerMojo App Profile. You can also exercise this right at any time by contacting us using the contact details at the end of this privacy policy.

9. Your location data

In order to get the most out of our service and to allow us and our participating venues to provide you with tailored offers, we need to process your approximate location from time to time. The types of location data that will be processed are your latitude, longitude, cell tower ID, etc. Your location data will only be processed for as long as necessary in order for us to respond to your request for tailored offers. After this the data will be deleted. The location data may be transferred to our merchants for the purpose of providing you with the best offers at that time to match your preferences. You can choose not to allow us to process your approximate location at the time you connect to the Sites, or any time after that either by changing the settings on your mobile device or by contacting us using the contact details at the end of this privacy policy. Please note that if you choose not to allow us to process your location data, we will not have enough data in order to provide you with the full benefit of our service (e.g. a list of offers from participating venues matched to your approximate location).

10. Security

We place great importance on the security of all personally identifiable information associated with our users. We have security measures in place to attempt to protect against the loss, misuse and alteration of personal information under our control. For example, our security and privacy policies are periodically reviewed and enhanced as necessary and only authorised personnel have access to personal information. Whilst we cannot ensure or guarantee that loss, misuse or alteration of information will never occur, we use all reasonable efforts to prevent it. You should bear in mind that submission of information over the internet is never entirely secure. We cannot guarantee the security of information you submit via the Sites whilst it is in transit over the internet and any such submission is at your own risk.

11. Storage of your information

Information that you submit via the Sites is sent to and stored on secure servers located in the United Kingdom and other jurisdictions. This is necessary in order to process the information. Information submitted by you may be transferred by us to our other offices and/or to the third parties mentioned in the circumstances described above, which may be situated outside the European Economic Area and may be processed by staff operating outside the European Economic Area. By submitting information via the Sites, you agree to this storing, processing and/or transfer.

12. No absolute safeguards

Although we will use reasonable efforts to safeguard the privacy of your information, transmissions on the Internet cannot be made absolutely secure. Accordingly, we assume no responsibility or liability for disclosure of any of your information due to errors in transmission, unauthorised third-party access or other causes beyond our reasonable control.

13. Your role in protecting your privacy

Please remember that protection of your privacy begins with you. You are solely responsible for maintaining the secrecy of any account ID or password you use to register, and you should always be careful and responsible whenever disclosing information online.

14. Cookies and similar technologies

Cookies use technologies that are essentially small data files placed on your computer, tablet, mobile phone or other devices (referred to collectively as a "Device") that allow the cookie owner/operator to record certain pieces of information whenever you visit or interact with our sites, services, applications, messaging and tools.

The specific names and types of the cookies, web beacons and other similar technologies (such as flash cookies, HTML 5 cookies and other web application software methods) we use may change from time to time.

When you visit or interact with the Sites, we or our authorised service providers may use cookies, web beacons and other similar technologies for storing information to help provide you with a better, faster and safer experience and for advertising purposes.

Service providers are companies that help us with various aspects of our business, such as site operations, services, applications, advertisements and tools. We might use service providers from time to time to help us to serve you relevant ads on our services and other places on the Internet. We do not explicitly permit any of these service providers to collect any of your personal information on our sites or in our services, applications or tools for their own purposes. We may use the terms "cookies" or "similar technologies" interchangeably in our policies to refer to all technologies that we may use to store data in your browser or Device or that collect information or help us identify you in the manner described above.

We offer certain features, services, applications and tools that are available only through the use of these technologies. You are usually free to block, delete or disable these technologies if your browser, installed application or device so permits. However, if you decline cookies or other similar technologies, you may not be able to take advantage of certain site features, services, applications or tools. You may also be required to re-enter your password more frequently during your browsing session. Generally, these technologies allow our sites, services, applications and tools to store relevant information in your browser or device and later read that information in order to identify you to our servers or internal systems.

We may use third parties, such as advertising networks and exchanges, to allow us to serve you advertisements. These third-party ad networks and exchange providers may use third-party cookies, web beacons or similar technologies to collect information. They may also collect your device identifier, IP address or identifier for advertising (IDFA). The information that these third parties collect may be used to assist us in providing you with more relevant advertising that we serve on our sites or elsewhere on the web. Third-party cookies are covered by the third parties' privacy policy.

15. Account Deletion

All users have the option of seamlessly deleting their account and account information by visiting their Profile section, located by selecting the Profile icon on the navigation bar.

This will lead the user to their Account page, where they are able to access their Settings using the ‘burger’ icon on the top right hand side of the page.

Towards the bottom of the Settings page, a ‘Delete my account’ link will enable to user to delete their account. Upon clicking the link, a confirm dialog box will be presented to the user. Clicking ’Delete’ will sign the user out and delete their details, redirecting the user to the ‘Login and Register’ screen

Once deletion has been enabled, the system will ensure that all personal data will be removed from the database.

16. Acceptance of Privacy Policy

If you use DinerMojo, you are accepting the terms and conditions of this Privacy Policy, and we will have the right to use your information as described in this Privacy Policy. If you do not agree to have your information used in any of the ways described in this Privacy Policy, you must discontinue use of DinerMojo.

17. Your rights

You have a legal right under the Data Protection Act 1998 to a copy of all the personal information about you held by us. On request, we will provide you with a copy of this information subject to a fee not exceeding £5. You also have a right to correct any errors in that information. As mentioned above, you have a right to prevent the use of your personal information for direct marketing purposes.

You have the right under GDPR to "be forgotten" and have your personal information removed from DinerMojo. If you decide that you would like to exercise this right, please click this link: email us asking to be forgotten under GDPR guidelines. The link lets you send us an email. Please send it from the email address you use for DinerMojo. In the email, please specify the email address associated with your account and make the explicit statement that "I wish to exercise my right to be forgotten under GDPR guidelines".
